How It Works (From Your Perspective)

You sign up as a verified seller in the NIL Fan Market.

We review:

  • Your product type

  • Your understanding of NIL and licensing guidelines

This ensures everyone in the marketplace is protected.

2️⃣ Get Approved & Publish

Once approved, you’ll receive access to your own seller dashboard — similar to platforms like Etsy or Shopify.

You:

  • Upload your products
  • Set your pricing
  • Manage inventory
  • Control your brand

This is still your business — we simply provide the audience and structure.

3️⃣ Fulfill Your Orders

When a fan purchases your product:

  • You receive the order
  • You handle fulfillment
  • You keep the majority share of the revenue

General Rules And Regulations

By participating as a Seller on The NIL Shop marketplace, you agree to operate in accordance with the following general rules and regulations.

1. Compliance With Laws & NIL Regulations

All Sellers must comply with:

  • Federal, state, and local laws
  • Name, Image, and Likeness (NIL) regulations
  • University and athletic department policies
  • Applicable tax and consumer protection laws

Sellers are solely responsible for ensuring their products and business activities remain compliant.

2. Intellectual Property Responsibility

Sellers may only upload and sell designs that:

  • They personally created, OR
  • They have written legal rights to use

The following are strictly prohibited:

  • Unauthorized university trademarks
  • Copyrighted images, logos, or slogans
  • Athlete names or likenesses without formal NIL authorization
  • Any misleading use of protected branding

The NIL Shop reserves the right to remove listings immediately if an intellectual property concern arises.

3. Accuracy & Transparency

Sellers must ensure:

  • Product descriptions are accurate
  • Photos represent the actual product
  • Pricing is clear and not deceptive
  • Fulfillment timelines are realistic

Misrepresentation of products may result in listing removal or account suspension.

4. Product Quality Standards

All products must meet reasonable quality standards, including:

  • Clean printing and finishing
  • Durable materials
  • Secure packaging
  • Professional presentation

Consistent quality issues may result in probation, suspension, or termination.

5. Fulfillment & Shipping Standards

Sellers must:

  • Ship orders within the stated processing time
  • Provide valid tracking information when applicable
  • Communicate delays promptly

Repeated shipping delays or failure to fulfill orders may result in account review.

6. Professional Conduct

Sellers are expected to:

  • Communicate respectfully with customers
  • Avoid harassment, discrimination, or abusive behavior
  • Conduct business ethically

The NIL Shop maintains zero tolerance for abusive or unethical conduct.

7. Marketplace Integrity

Sellers may not:

  • Manipulate reviews
  • Create fake accounts
  • Circumvent platform fees
  • Direct customers off-platform to avoid commissions
  • Attempt to copy or replicate other Sellers’ proprietary designs

Maintaining marketplace integrity is essential to protecting all Sellers and athletes.

8. Content Standards

Listings may not include:

  • Obscene or explicit content
  • Hate speech or discriminatory messaging
  • Illegal or unsafe products
  • Content that damages the reputation of athletes, collectives, or institutions

The NIL Shop reserves sole discretion to determine whether content violates platform standards.

9. Platform Discretion

The NIL Shop may:

  • Remove listings
  • Withhold payouts pending investigation
  • Suspend or terminate Seller accounts
  • Request additional documentation at any time

These actions may be taken to protect customers, athletes, collectives, or platform integrity.

10. Agreement to Updates

Marketplace rules may evolve as NIL regulations and platform features change. Continued participation constitutes agreement to updated rules.
Payments, Payouts, & Taxes

Revenue Split Structure

Each sale is automatically divided as follows:

  • Seller Share: Seller receives their agreed commission percentage (default: 70% unless otherwise specified).
  • Athlete/Collective Share: A percentage of every sale supports the designated athlete or NIL collective.
  • Platform Fee: The NIL Shop retains a marketplace fee for hosting, payment processing, marketing, and platform management.

Final payout percentages are displayed in each seller’s dashboard.

Payout Schedule

  • Seller earnings are added to their Fan Market account balance after an order is marked fulfilled.
  • Funds become eligible for payout after a 7–14 day hold period to account for refunds, chargebacks, and fraud prevention.
  • Payouts are processed via Stripe Connect on a bi-weekly basis (or as otherwise selected by the seller, if available).
  • A valid bank account must be connected to receive payouts.

Fees & Deductions

The following may be deducted before payout:

Payment processing fees
Platform marketplace commission
Refunds or chargebacks
Applicable sales taxes or regulatory fees (if required by law)

Sellers are responsible for their own income tax reporting. 1099's will be distributed when required.
